1. Acceptance of Terms

By accessing or using Apiary ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Apiary ("we," "us," or "our") operates this Service.

2. Description of Service

Apiary provides access to multiple AI language models (including but not limited to Claude, GPT, and Gemini) through a unified subscription interface. We offer tiered plans with monthly credit allowances and a rollover credit system. Credits that are not used in a given month roll over to future months, subject to the caps described in your plan.

3. Accounts

You must create an account to use Apiary. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and current
• Notifying us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent.

4. Subscriptions and Credits

Apiary operates on a credit-based system. Each plan includes a monthly credit allowance which refreshes at the start of your billing period. Unused credits roll over and accumulate up to three times your monthly allowance. Credits are consumed when you send messages, with the cost per message varying by routing mode (Fast, Smart, Pro).

Cancellation: If you cancel your subscription, your remaining credit balance remains accessible for 60 days from the cancellation date, after which unused credits expire.

Refunds: Subscription fees are non-refundable except where required by applicable law. Unused credits have no cash value and cannot be redeemed for currency.

5. Acceptable Use

You agree not to use Apiary to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of any party
• Attempt to circumvent usage limits, access controls, or billing systems
• Resell or redistribute access to the Service without our written consent
• Use automated scripts or bots to access the Service except via our official API
• Generate spam, misinformation, or content designed to deceive

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. AI-Generated Content

Apiary routes your prompts to third-party AI providers. The outputs are AI-generated and may be inaccurate, incomplete, or inappropriate. You are solely responsible for how you use AI-generated content. We do not endorse, verify, or take responsibility for the accuracy of AI outputs.

You retain ownership of the prompts you submit. By submitting prompts, you grant us a limited license to process them for the purpose of delivering the Service. We do not use your conversations to train AI models.

7. Intellectual Property

The Apiary name, logo, and branding are our intellectual property. You may not use them without our written permission. The software and systems underlying the Service are also our property or licensed to us.

8. Availability and Modifications

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service at any time. We may also change pricing or plan terms with at least 30 days notice to active subscribers.

9. Third-Party Services

Apiary integrates with third-party AI providers (Anthropic, OpenAI, Google) and payment processors (Stripe). Your use of these services is also subject to their respective terms. We are not responsible for the actions or outputs of third-party providers.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Apiary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you shall not exceed the amount you paid us in the three months prior to the claim.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dallas County, Texas.

13. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
